SF State Gender Equity & Title IX/VAWA Mandatory Notice

Dear SF State Colleagues,

Happy new year – new academic year, that is! 

SF State has a long self-stated commitment to access, equity and inclusion, and our efforts to support Title IX, promote gender equity and prevent sexual violence fall in line with our core values.  As we start the Fall 2015 term, I ask for your assistance and support with cultivating a working and learning environment reflective of SF State’s core beliefs in social justice.  

New federal legislation went into effect in March 2014 which required campuses to better promote gender equity and campus safety; a summary of these changes can be found on the American Council on Education’s website.  Since then, continuing changes to state/federal law and in university policy reinvigorate our obligation both to reduce the likelihood of sex and gender discrimination, and of sexual harassment and sexual violence, as well as to promote a safer, more inclusive climate for all students, faculty and staff.

I encourage you to take the time to become familiar with CSU Executive Order 1095, updated June 2015, regarding our responsibilities relative to Title IX and the Violence Against Women Act.  Executive Order 1096 outlines the procedures SF State is to follow when an employee files a complaint.  Here are some of the key changes in the policy that you should be aware of:

·         A new category of prohibited behavior, sexual misconduct, has been added, which includes any sexual activity engaged in without affirmative consent, where affirmative consent means an informed, conscious, voluntary, and mutual agreement to engage in sexual activity.

·         Employees are prohibited from entering into a consensual relationship with any student or employee over whom they exercise direct or otherwise significant academic, administrative, supervisory, evaluative, counseling, or extracurricular authority.

·         Both Complainants and Respondents now have the right to appeal the finding of an investigation, as well as appeal any sanctions imposed following a finding of responsibility in a Title IX incident.

·         While reporting as soon as possible maximizes SF State’s capacity to respond effectively to a reported incident, there is no longer a time limit for when a Complainant may come forward to report a potential violation of policy.

·         Complainants may now request an Early Resolution Process when filing a complaint under EO 1096; the purpose of the Early Resolution Process is to explore whether the Complainant’s concern(s) can be resolved by SF State without an investigation.

·         Employees, as well as students, will have access to a confidential victim-advocate through The SAFE Place if they wish to have one.

Two things in particular will be essential to observe as you review the above websites.  First, all employees will need to complete annual training; once the meet and confer process with all collective bargaining units is complete, additional information will be forthcoming on this requirement.   Second, unless otherwise noted by policy, all employees have a duty to report and are required to *immediately* report allegations of sexual harassment/sexual violence – even when the victim/survivor requests confidentiality of them - to any of the following Title IX personnel:

SF State's Response to Sexual Misconduct & Sexual Violence 

Dear SF State Student,

Happy new year – new academic year, that is! To our newest students: congratulations on your admission to SF State and welcome again to the home of the Gators!  And to our returning students: we are glad you’ve come back to continue your educational pursuits with us.  As you review your course syllabi and schedule for the upcoming semester, please take the time to read this email thoroughly, as you are responsible for the contents.

I have already sent emails to the staff and faculty asking for their help and support with cultivating a learning environment reflective of SF State’s core beliefs in social justice.  Continuing changes to state/federal law and in university policy reinvigorate our obligation both to reduce the likelihood of sex and gender discrimination, and of sexual harassment and sexual violence, as well as to promote a safer, more inclusive climate for all students, faculty and staff.

Two things in particular will be essential to observe as you review the above websites. First, all new/incoming students will need to complete required training on issues related to sexual harassment/sexual violence. Thank you to those who have already completed the Campus Clarity online program (an email was first sent to you over the summer). If you have yet to complete this program and this is your first semester at SF State, please do so ASAP.  You can contact Osvaldo Del Valle, Assistant Dean of Students & Director of Student Conduct for further information.

Second, students should be aware that with only few exceptions, if they report or disclose an experience of sexual harassment/sexual misconduct/sexual violence to any SF State staff/faculty member, that employee is required to *immediately* report allegations of sexual harassment/sexual violence – even if the student is requesting confidentiality - to any of the following Title IX personnel:

Students, Part II (Prevention) - September 2015 

Toward a Campus Without Sexual Violence 

Dear SF State Student,

I hope that your first couple of weeks into the new semester are going well and that you are enjoying meeting new friends and learning from new faculty!  Earlier this week, I wrote to you about SF State’s response to sexual misconduct and sexual violence.  I provided some info about our applicable policies, as well as resources available to you as a student.  In this email, our focus is going to be on your role in helping SF State reduce the incidence and prevalence of sexual violence.  In an ACHA National College Health Assessment Survey administered in February 2015, we learned from SF Students that during the prior 12 months:

·         8.2% had experienced sexual touching without their consent

·         3.0% had experienced attempted sexual penetration without their consent

·         2.1% had experienced sexual penetration without their consent

·         2.0% had experienced a sexually abusive intimate relationship

I would like to challenge you as students to exercise your leadership and citizenship by doing your part in reducing sexual violence on campus (including sexual assault, domestic violence and stalking) and eradicating gender discrimination. By empowering yourself with educational resources on how to recognize, prevent, and respond to sexual violence and other behaviors inconsistent with our values, you can make an incremental positive impact on the SF State community.

While men, women, and transgender individuals are all at risk of becoming victims of sexual violence, the research shows that men comprise a disproportionately greater number of perpetrators. However, most men are not perpetrators! This means men have a key role to play in helping to promote gender equity by stepping up to end sexual violence. Men Can Stop Rape in Washington, DC, has been at the forefront of helping male college students make a difference on their campuses by “showing their strength” in different and positive ways. It will take the collective, concerted effort of all SF State community members to end sexual violence.  Victims are never to be blamed for a sexual assault; a review of the common myths and facts about sexual violence can help dispute some of the reasons why victims have historically been wrongly held responsible for their own victimization – in a way no other crime victims are perceived.

Yet, until sexual violence is eradicated, there are still proactive strategies that each SF State student can adopt to possibly reduce personal risk.  Please consider the following:

When in social situations:

  • Effective communication is key when it comes to negotiating consent in sexual relationships.  Be sure to obtain affirmative consent from your partner before engaging in sexual activity.  Be clear when you mean no and when you mean yes. When in doubt, ask your partner about their wishes.
  • Each student should consider minimizing alcohol consumption and avoiding the use of mind‐altering substances to maximize the degree of self‐control and effective decision‐making you possess. The importance of this escalates when you are in public places or with individuals you do not know.
  • At a bar or party, avoid leaving your drink unattended or accepting drinks from individuals you do not know; when possible, only purchase or consume single‐serving beverages and ask the server to open the container in your view. This minimizes the possibility of “date rape” drugs being placed in your drink. And remember that alcohol is the most commonly used “date rape” drug!
  • Trust your instincts: if you get that “sixth sense” that something doesn’t “feel” right or you are in danger, don’t worry about the other person’s feelings: take immediate actions to get out of the situation or to safety ASAP, and then analyze (or apologize!) if you need to later.
  • Statistics indicate that most victims are likely to be sexually assaulted or raped by somebody that they know; it’s important to remember that while we can’t go through life with our “armor” up all the time, it is prudent to regard safety as something that you should always be mindful of.

When around campus:

  • At night, whenever possible, please walk with others to your car, to campus buildings, etc.  If you must walk alone at night, elect to use well‐lit walkways, busier streets, or high‐traffic pathways as much as possible.  You can also contact the CARE Program to request an escort for your safety by calling (415) 338-7200 and telling the dispatcher where you would prefer to be met.
  • When working or studying alone at night in an isolated location, be sure to let friends, family, roommates, etc., know both your whereabouts and your estimated time for returning home.
  • Leverage modern technology to help promote personal safety; there are a variety of apps for iOS and Android platforms that can help you stay connected with friends and family in real‐time. One example is the award‐winning Circle of 6 app (visit http://www.circleof6app.com for info on downloading).
  • If you observe parts of campus that might pose a safety concern, e.g., lighting is not working, please contact the SF State University Police Department by calling their 24-hour non-emergency number: (415) 338-7200.
